STEP 1: Apply for and obtain a labour market opinion, if you need one*
STEP 2: Using your positive labour market opinion, apply for a work permit at a consulate, embassy or high commission overseas, or at a port of entry in Canada
STEP 3: Arrive in Canada and get started working
* While most jobs require a labour market opinion, there are a scenarios where a foreign worker does not require a labour market opinion to work in Canada. An example would be professions and citizens covered by the North American Free Trade Agreement.
The Labour Market Opinion (LMO)
The employer needs to demonstrate a few key factors to successfully obtain a positive LMO:
- That there was no SUITABLE Canadian citizen or permanent residence easily available to perform the job for which you are being hired. This requires submitting proof of their recruitment activities
- That they can afford to pay you the prevailing wages to perform your job
- That they have been complaint with the laws as it relates to other foreign workers they may have hired in the past.
The Work Permit
As a prospective foreign worker whose employer has obtained a positive LMO, you need to demonstrate the following to an immigration officer in order to obtain a work permit:
- That you are qualified to perform the duties for which you are being hired as set out in the LMO
- That your purpose in Canada is temporary and that you will leave Canada at the end of your authorized stay
